해외 동물학대 처벌기준과 양형기준을 통해 살펴본 우리나라 동물학대 양형기준 방향성 논의

초록
본 연구는 동물학대 행위 양형기준 마련을 앞두고 해외의 동물학대 처벌 기준에 대한 검토와 비교를 통해 우리나라 양형기준이 나아가야 할 방향성을 논의하는 것을 주요 목적으로 삼는다.
이를 위해 미국과 영국의 동물학대 처벌 관련 규정들을 검토하고, 동물학대 행위에 대한 개별 양형기준을 마련하여 적용하고 있는 영국의 동물학대 양형기준을 검토하도록 한다.
미국의 동물학대 관련 법으로는 '동물복지법'과 '동물학대 및 고문방지법'이 있으며, 동물 압살행위 영상을 규제하는 '동물학대 및 고문방지법'은 최대 7년의 징역형 선고가 가능하다. 단순 높은 징역형 기준 이외에도 동물 학대 행위를 다양한 범위에서 규율하고 있으며 선고 단계에서도 다양한 보안처분과 소유 금지 등의 부수처분을 활용하고 있음을 확인할 수 있었다.
영국의 경우 '동물보호법'을 발전시켜 '동물복지법'으로 개정하였고 최근 개정으로 중한 동물학대에 관하여는 최대 5년 이하의 징역형과 최고 금액의 한도가 없는 벌금형 선고가 가능하다. 영국 역시도 중대한 위해를 가한 학대자에게는 소유권을 박탈하고 성적 학대자의 경우 동물 소유와 거주를 금지하는 등의 부수적 처분을 강화하고 있음을 확인하였다.
이를 바탕으로 본 연구는 우리나라 동물 학대 양형기준 마련 시 동물학대 행위의 범위를 더욱 확대하는 것, 가중요소로서 미성년자 앞에서의 범죄행위, 영상 제작 행위, 그리고 혐오 감정에 기인한 범죄인 경우를 고려하는 것을 제안하고 있다.
The main purpose of this study is to discuss the direction in which our country's sentencing guidelines should move forward by reviewing and comparing overseas animal abuse punishment standards ahead of the establishment of animal cruelty sentencing guidelines.
To this end, we will review the regulations related to the punishment of animal abuse in the United States and the United Kingdom, and review the animal cruelty sentencing guidelines of UK that are applied by establishing individual sentencing guidelines for animal cruelty.
In the United States, laws related to animal abuse include the "Animal Welfare Act" and the :Preventing Animal Cruelty and Torture Act". The PACT, which regulates videos of animals being slaughtered, can result in a prison sentence of up to 7 years. In addition, it was confirmed that the scope of animal cruelty is diverse and that the court utilizes a variety of security measures to prevent recidivism and protect victimized animals.
In the UK, the "Animal Protection Act" was developed and revised into the "Animal Welfare Act" to prohibit animal cruelty and stipulate sentences of up to 5 years in prison and fines with no maximum amount. It was confirmed that the UK is also strengthening security measures, such as depriving abusers who cause serious harm of ownership and prohibiting sexual abusers from owning or living in animals.
Based on this, this study proposes to further expand the scope of animal abuse behavior when establishing sentencing guideline for animal cruelty in Korea, and to consider criminal acts in front of minors, video production, and crimes motivated by hate feelings as aggravating factors.
